You gotta beat the game with all 8 starter characters, and then you face Luigi in a 1v1. Beat him and he's yours!

Just play Classic mode with all 8 default characters. When you beat it with everyone, you'll fight and unlock Luigi.

I'm not sure there's a DS version of Super Smash Bros 64, but on N64 you unlock Luigi by beating Classic mode with all 8 characters.
