Just restart the mission or reload a previous save. Sometimes the simplest solution is the best one!

I've had this happen to me! What worked for me was completing a few missions for the faction that confiscated my items. Eventually, I got the option to get them back as a reward.

Visit the nearest security outpost or station where your items were taken. Look for an evidence locker or talk to the security officers. They usually have a way for you to reclaim your stuff after settling any penalties.
