The game developers often struggle to secure all the necessary player rights. Not everyone agrees to be included or wants to negotiate.

It's mainly due to licensing issues. Some players' rights are hard to obtain or come with high costs.

Pretty much boils down to money and negotiations. Not all former players are interested in being in the game or might want more cash than 2K can offer.

I read somewhere that certain retired players don't want their likenesses used in games, probably for personal reasons. Gotta respect that choice.
