Sasuke went to jail in Boruto because he tried to assassinate the Five Kage and was considered a dangerous criminal. Attempted coup d'état is a pretty solid reason to get some jail time, even for a ninja!

In Boruto, Sasuke's past actions, like trying to destroy the Hidden Leaf Village and attempting to kill Naruto, landed him in jail. Old habits die hard, I guess.
