He's in the game as an Assist Trophy, so he's kinda in there, just not as a playable character.
Waluigi isn't in Smash Ultimate because the developers simply haven't chosen to include him yet. Maybe he's off playing tennis or something.
Rumor has it that Waluigi's just too powerful for Smash. The developers are protecting us from his true potential.
