Blame it on licensing issues! The original Tetris was developed by a Russian programmer, and the rights have been a legal labyrinth ever since.

Nintendo probably couldn't include it because they don't have the current rights to the original NES version. Sucks but true.

Simply put, it鈥檚 a licensing issue! The rights to Tetris have been all over the place, and Nintendo couldn't secure them for the NES Classic.
